california just reelected herself the other night, a veteran of the intelligence committee said she wished that president obama had not accepted petraeus' resignation, that he didn't need to leave office for an indiscretion of that kind. the president didn't immediately accept it, but ultimately he gave in to the logic that petraeus himself was emphasizing, which is it simply wasn't tenable for him to stay in the job having done what he did. and i think everybody is disappointed because petraeus's talents are recognized by people in both parties and have been for years. but he is -- he is paying a very, very stiff price for the mistake that he made. and the white house is simply going to have to roll with that. >> and there are a lot of folks, john harwood, this afternoon, especially out there on twitter and the blogosphere who are raising questions about all of this happening so close to the time he was set to testify next week, that closed door meeting on the hill regarding benghazi. >> everything we know about this so far is that is simply the speculation. and with the touch of paranoia

is california's proposition 8. this was the ballot proposition passed, overturned two years ago. what it says is that even though a california court said that marriage was legal in that state, it banned gay mrarnlg in california. now if the court grants that case, then it might -- might -- get to the fundamental issue whether states can, in fact, ban same-sex marriage. my predictions, chris. it's a virtual certainty the court will take the doma case. courts have overturned an act of congress. it's much less certain they'll take the prop 8 case and we'll only find out today which cases they're going to take because if they're not going to take any cases we won't hear about that until monday. all we get are the grants. no guarantee today but the justices are meeting in a closed door conference. these cases are on the agenda. so we may find out as early as today, chris. >> nbc's justice correspondent pete williams. for the record i would watch a show called pete's predictions. thank you, pete. >> reporter: you'd be the one. >>> next, we'll head to the hill to talk to members from both sides abou

me take you into it. this morning, by far the worst weather all through california. i just read something that at some of the highest elevations in the mountains in california could get up to 100 inches of snow. 100 inches of snow over the next three to four days. crazy. it's raining hard this morning in san francisco to sacramento. san francisco, it's going to be a rainy three days. another big storm coming in saturday afternoon, saturday night. it's going to rain through sunday. you get a break monday, then another storm on tuesday. we have a lot of flooding concerns in the rivers in california in the days ahead. let me take you through the forecast as we go at it. this huge storm in the west, it's not going to move across the country. it's just going to stall out. if you're anywhere from denver to the east coast, don't expect a lot of wet weather this weekend. it should mostly be dry. and notice the temperatures. they're warming up in the middle of the country, and that will head east as we go throughout the weekend. so your friday forecast, really no airport concerns out the

. i live in mississippi but i'm retired federal firefighter from california. and disasters, whether it's hurricanes, tornadoes, earthquakes, wildfires, whatever, most jurisdictions find that they're overwhelmed by the time it happens because disasters overwhelm every jurisdiction. so whether you're in new york or down in the coast of mississippi, the jurisdictions that are in charge of trying to mitigate these problems are so overwhelmed, and most are victims themselves. we need a national -- we need a national fire disaster program that exists within the federal government. the resources are there without going to a lot of expense. all disasters is similar to what would happen in a motel. a hotel, if everybody goes into a hotel, they see on the door what to do when a fire starts, how to get out, the hallways are designed to carry the capacity of the people, and so forth. and then once they're out they need to be accounted for. and he'd have an emergency service that can come in and mitigate the problem. most jurisdictions do not have the resources to do this. when it comes to police a

of the northeast, it's now a recovery mission. and yesterday california military planes were loaded with utility vehicles ready to be shipped into new york. an army of some 50,000 utility workers from across the country, even canada, being deployed to the region to help in the massive project to restore power which will take weeks. three navy warships are anchored off the northeast coast to help with the relief effort. in new jersey, military trucks are being deployed to operate as polling places on election day in the hardest-hit communities still remain without power. now, the good news does trickle out slowly. today amtrak will begin offering limited service between new york city and boston. and new jersey transit will also start moving today with limited service. the new york subway system continues to make advances. the "m" train linking queens to manhattan just started running, but there are still no trains running below 34th street where half of manhattan remains in the dark. so the millions of new yorkers who depend on subways, they're now waiting in those long lines for buses. for those

relatively little fanfare. voters in california approved a ballot measure to reform the state's notorious three strikes law. one of the strict he's sentencing policies in the nation. under the law, if a defendant has two serious convictions, a third conviction for any felony automatically resulted in imprisonment 25 years to life. that meant that a crime like shoplifting could earn the offender a life sentence. under the revised law, a life sentence goes into effect if the third felony is a violent crime. california's decision is a long overdue movement on the practice of imposing the heaviest sentences for the lightest of crimes. unfortunately, there's been much less progress when it comes to u.s. drug policy and reform around mandatory minimum sentencing. the 1986 anti-drug abuse act was passed after the death of university of maryland player len bias from a drug overdose. it started by tip o'neil of making a demonstration of being tough on crime. it was intended to prosecute high-level drug dealers. what it actually did was to ensnare low level offenders for small quantities of drugs b
